Eligibility. BEATPORT 3.0.COM (www.beatport.com) IS THE SPONSOR ("SPONSOR") OF THIS "Bear Who - The Beatbox" ("CONTEST").
THIS CONTEST IS OPEN TO INDIVIDUALS WHO ARE EIGHTEEN (18) YEARS OF AGE OR OLDER AS OF JULY 1, 2007 ("ENTRANTS"). IF YOU ARE NOT EIGHTEEN (18) YEARS OF AGE OR OLDER YOU ARE NOT ELIGIBLE TO WIN A PRIZE. If you are under the legal age of majority in your state of residence (a "Minor"), one of your parents or legal guardians must submit a signed, written statement that they have read, understood and agree to these Contest rules with your entry, and that such agreement constitutes acceptance of these Contest rules on behalf of you and themselves.
To be eligible to win a prize, entries must be completed and received by Sponsor in the format designated below. Directors, officers and employees of Sponsor, its parent, and any of their respective affiliate companies, subsidiaries, agents, professional advisors, advertising and promotional agencies, and immediate families of each are not eligible to win any prizes. All applicable federal, state and local laws and regulations apply. Offer void where prohibited by law. In the event of any dispute, entries will be deemed to have been submitted by the owner of the e-mail address from which the e-mail was sent.
ENTRY DATES AND DEADLINES: The Contest shall commence on August 08, 2007 at 12:00 a.m. Eastern Daylight Time and end on September 8, 2007 at 11:50 p.m. Central Standard Time (the 'Contest Period').
TO ENTER: Create a remix of Bear Who?'s song "The Beatbox". Submit your completed entry by uploading an MP3 file of your remix via the Internet, along with your name, email address and the title of your remix, to the contest website at www.groovesourcemedia.com . Entries must be submitted within the Contest Period, not later than Sebptember 6, 2007 at 11:50 p.m. Central Standard Time. Any entrant may submit multiple entries.
ACCEPTANCE OF RULES; WARRANTY OF ELIGIBILITY. By participating, entrants agree to abide by these official Contest rules and warrant that they meet the eligibility requirements set forth herein.
DISCLAIMER. Sponsor, Bear Who? and all participating sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees and agencies will not be responsible for: (a) any late, lost, misrouted, garbled or distorted or damaged transmissions or entries; (b) any telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures; (c) any Contest disruptions, injuries, losses or damages caused by events beyond the control of Sponsor; or (d) any typographical errors in any materials associated with the Contest. Without limiting anything to the contrary contained herein, Sponsor all participating sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees and agencies make no warranty that any particular remix/sequencing software program will function as required for this Contest. It is your sole responsibility to ensure that your recording/remix system(s) functions correctly.
Entrants hereby represent and warrant that all of the music, vocals or additional lyrics included in their remixes ('Entries' or individually, the 'Entry') (other than the "The Beatbox" multitracks provided on https://www.beatport.com) are wholly original and that no music, vocals or lyrics have been copied from any other source or otherwise violate any third party rights. Sponsors will not be responsible or held liable for any music, vocals or lyrics which are included in any submitted materials which have been copied from any other source.
Entries are the property of Bear Who?/Dust Traxx. You hereby agree not to duplicate, sell or otherwise exploit in any manner any portion of the Entry or the original master recordings at any time without Bear Who?/Dust Traxx's prior specific written consent. Bear Who?/Dust Traxx reserves the right to cancel or modify the Contest if fraud, technical failures or any other factor beyond Bear Who?/Dust Traxx's reasonable control impairs the integrity of the Contest as determined by Bear Who?/Dust Traxx in its sole discretion. Bear Who?/Dust Traxx reserves the sole right to extend the deadline of the determinations of the winning Entries for one extension period of thirty (30) days. By entering this contest, you expressly agree that all of the results and proceeds of the Contest Entry are and shall be, from the inception of creation, a "work made for hire" for Bear Who?/Dust Traxx. You further acknowledge, certify and agree that Bear Who?/Dust Traxx shall be deemed the author and/or exclusive owner throughout the world of any and all rights in and to all the materials comprising the Entry (including, but not limited to, the right, title and interest in and to the worldwide copyrights in the "sound recording(s)" (as defined in the Copyright Act of the United States of America) and underlying composition embodied therein and any renewal or extension of rights in connection therewith), and of any and all other rights thereto.
In the event that the services rendered in connection with the Entry are not deemed to be "works made for hire", then the rights therein shall be deemed irrevocably transferred to Bear Who?/Dust Traxx by virtue of this agreement. You will, upon request, execute, acknowledge and deliver to Bear Who?/Dust Traxx such additional documents as Bear Who?/Dust Traxx may deem necessary or desirable to evidence and effectuate the foregoing.
Any entrant found to be submitting mass entries and/or reproductions and any entrants suspected of or found to be misrepresenting themselves through the use of aliases and/or addresses or otherwise will be disqualified. Except where prohibited by law, by participating in this Contest, you are granting Bear Who?/Dust Traxx, and those acting under its authority, permission to use your name, photograph, voice and/or likeness for advertising, publicity and/or other business purposes in connection with the Contest without compensation.
JUDGING: Eligible entries will be judged by Bear Who?/Dust Traxx. All eligible entries will be listened to and rated on the basis of originality and creativity, technique, sonic quality and viability in the dance market. Winners will be determined on or shortly after September 8, 2007.
NOTIFICATION: Winners will be notified by e-mail by the close of business September 9, 2007. Winners will have forty-eight (48) hours from the date of attempted notification to respond to the notification via telephone or e-mail. In the event that any Winner does not respond to the notification within this forty eight (48) hour period, that Winner will be deemed to have forfeited his/her win. The next highest rated Entry will be chosen from the remaining eligible entries. Bear Who?/Dust Traxx is not responsible for late, lost or misdirected notification. Winners will be required to sign and return to Bear Who?/Dust Traxx an agreement of participation in the form provided by Bear Who?/V2. Affidavits and Releases sent via facsimile will be accepted in order to comply with the referenced time constraint but the original must be mailed to Bear Who?/Dust Traxx contemporaneously. In the event that a Winner cannot be contacted, does not meet the eligibility requirements, or fails to return a complete, notarized Affidavit and Release within the specified time period, such Winners will be deemed in Bear Who?/Dust Traxx' sole discretion, to have forfeited his/her win and chances to participate.
PRIZES: The Grand Prize Winner will be awarded a Dust Traxx Digital Discography by GrooveSource Media. Estimated value of grand prize winner pack: $1500.00. The Grand Prize Winner's Submission will be made available for sale as an official Dust Traxx release/ Beatbox Remix via Beatport.com.
A second place winner up will be selected and, at the discretion of the judges will receive a Best of Dust Traxx Digital Discography by GrooveSource Media: Estimated value of second place winner pack: $500.00. The Second Place Winner's Submission will be made available for sale as an official Dust Traxx release/ Beatbox Remix via Beatport.com.
Three runner ups will be selected and, at the discretion of the judges will receive a Dust Track Digital Singles Pack. Estimated value of runner up packs: $75.
Odds of winning a prize depend on number of eligible entries received. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNER.
GENERAL RELEASE. By entering the Contest, you release Sponsor, Bear Who?, Dust Traxx,and any of their respective parent companies, subsidiaries, affiliates, directors, officers, employees and agencies (collectively, the "Released Parties") from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or delivery, misdelivery, acceptance, possession, use of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.
RULES: Entrants are encouraged to print out a copy of these official Contest rules for future reference.
WINNER: Winner will be announced on the Beatport website on or shortly after September 10, 2007.
